Terms of Service for Unprompted

Welcome to Unprompted, an iOS app developed and operated by Whio Studios Pty Ltd ("we," "our," or "us"). By downloading, installing, or using the Unprompted app (the "App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Use of the App

Unprompted provides writing prompts and tools to help you create simple stories. You agree to use the App only for lawful purposes and in accordance with these Terms.

2. Account and Syncing

  • Your content is synced via Apple's iCloud service using CloudKit and SwiftData.
  • You are responsible for maintaining the confidentiality of your Apple ID and password.
  • We are not responsible for any data loss due to issues with iCloud or your device.

3. Payments and Subscriptions

  • Payments and subscriptions are managed through RevenueCat and Apple's in-app purchase system.
  • All purchases are subject to Apple's terms and conditions.
  • We do not process or store your payment details directly.
  • Subscription terms, billing, and cancellations are handled through your Apple account.

4. Analytics

  • We use PostHog to collect analytics data about app usage to improve our services.
  • This data is collected anonymously and in aggregate.
  • You can opt-out of analytics tracking via the app settings or your device preferences.

5. Intellectual Property

  • All content, features, and functionality of the App, including text, graphics, logos, and software, are owned by Whio Studios Pty Ltd or its licensors.
  • You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

6. User Content

  • You retain ownership of any content you create using the App.
  • By using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content for the purpose of providing and improving the App.
  • You are solely responsible for the content you create and share.

7. Disclaimer of Warranties

  • The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
  • Use of the App is at your own risk.

8. Limitation of Liability

  • To the maximum extent permitted by law, Whio Studios Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App.

9. Apple's Terms and Policies

Your use of the App is also subject to Apple's End User License Agreement and App Store Terms of Service.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitute your acceptance of the updated Terms.

11. Termination

We may suspend or terminate your access to the App at any time, without notice, for violation of these Terms or for any other reason.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Whio Studios Pty Ltd is registered (Australia).
