Mushy Mood Terms & Conditions

Welcome to Mushy Mood! These Terms & Conditions ("Terms") govern your access to and use of the Mushy Mood mobile application and related services ("Services"). Please read these Terms carefully before using the app.

By using Mushy Mood, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. About Mushy Mood

Mushy Mood is a mobile app that allows you to track your daily mood and engage in creative activities such as writing, photography, and art. Content you create may be stored locally, in iCloud, or within the app's database depending on the type of entry.

Important: Mushy Mood is intended as a wellness and creativity tool only.
It is not a medical service, therapy, or substitute for professional care.
If you have concerns about your mental health, you should consult a qualified professional or seek immediate help if needed.

2. Eligibility

You must be at least 16 to use Mushy Mood.
By using the Services, you confirm that you meet this age requirement.
If you are under the age of majority in your jurisdiction, you must have a parent or guardian's permission.

3. Subscriptions & Payments

Mushy Mood may offer free and paid features.
Payments and subscriptions are managed through RevenueCat and the App Store.
We do not process or store your credit card details; Apple and RevenueCat handle this securely.
Subscription terms (including pricing, renewal, and cancellation) are subject to the App Store's policies.
You are responsible for managing your subscription and ensuring your payment information is up to date.

4. User Content

4.1 Ownership

You retain full ownership of the content you create in Mushy Mood (e.g. mood entries, writing, photos, art).

4.2 Responsibility

You are solely responsible for the content you create, import, or upload. Do not use the Services to store or share illegal, harmful, or abusive material.

4.3 Storage

Writing entries are stored in the app's database and synced via iCloud using SwiftData.
Photos and art are handled via system APIs (e.g. Camera, File Import) and may also be stored in iCloud.
We cannot guarantee indefinite storage of your content; you are responsible for backups if needed.

5. Acceptable Use

You agree not to:

Use Mushy Mood for unlawful purposes.
Interfere with or disrupt the app's functionality.
Attempt to reverse-engineer, copy, or modify the app beyond what is permitted by law.
Upload malicious software or harmful code.
Harass, abuse, or endanger others through the app.

6. Disclaimers

Mushy Mood is provided "as is" without warranties of any kind.
We do not guarantee that the Services will be error-free, secure, or available at all times.
Wellness Disclaimer: Mushy Mood is not a replacement for professional therapy or mental health treatment.
If you are experiencing distress, crisis, or serious mental health concerns, please seek help from a qualified professional or call your local emergency number.

7. Limitation of Liability

To the maximum extent permitted by law:

We shall not be liable for any indirect, incidental, or consequential damages arising from your use of Mushy Mood.
Our total liability for any claim related to the Services shall not exceed the amount you paid (if any) in the past 12 months.

8. Privacy

Your use of Mushy Mood is also governed by our Privacy Policy. Please review it to understand how we collect and handle data.

9. Termination

We may suspend or terminate your access to Mushy Mood at any time, without prior notice, if you violate these Terms or misuse the Services.

You may also stop using Mushy Mood at any time and delete the app from your device.

10. Changes to These Terms

We may update these Terms from time to time.
If changes are material, we may notify you in-app or by other reasonable means.
The latest version will always be posted here with the updated Effective Date.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles.
You agree to submit to the jurisdiction of the courts located in Victoria, Australia for any disputes.
