Terms of Service – Hot Seat

1. Overview

Hot Seat ("the App") is provided by Whio Studios ("we", "us", "our"). The App offers conversational prompts and icebreakers for personal use.

By downloading, accessing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the App.

2. Eligibility and Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

You must not:

Use the App in any way that violates applicable laws or regulations
Use the App to harass, abuse, or harm others
Misuse, disrupt, or attempt to gain unauthorised access to the App or its systems

We reserve the right to suspend or terminate access to the App at our discretion where these Terms are breached.

3. Informational Nature of Content

The App provides general-purpose conversation prompts only. Content is provided for informational and entertainment purposes and does not constitute advice of any kind.

You acknowledge that:

Prompts may be interpreted differently by different users
You are solely responsible for how you use and communicate any content from the App
You must exercise appropriate judgement and discretion in all interactions

4. User Responsibility and Conduct

You are solely responsible for your conduct and interactions with others when using the App.

Whio Studios does not control and is not responsible for:

User behaviour or interactions arising from use of the App
Any outcomes resulting from conversations initiated using the App
Any offence, harm, or damages resulting from use of the App content

5. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to:

Fitness for a particular purpose
Accuracy or reliability of content
Availability or uninterrupted access

6. Limitation of Liability

To the maximum extent permitted by law, Whio Studios will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of data
Loss of goodwill
Personal, social, or professional consequences arising from use of the App

This applies whether the claim arises in contract, tort, or otherwise.

7. Subscriptions and Payments

The App may offer paid subscriptions or features.

Payments are processed via Apple's App Store and third-party service providers, including RevenueCat.

Subscriptions renew automatically unless cancelled
You may manage or cancel subscriptions via your Apple ID account settings
We do not store or process payment details directly

8. Data Storage and iCloud

The App may store user data locally and synchronise it with the user's personal iCloud account using Apple-provided services.

Data stored in iCloud is controlled by the user
We do not access or store private iCloud data on our servers

9. Modifications to the App

We reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after updates constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law principles.
